WARRANTY
The NextSpeed Inc. Warranty Program is designed to assure our customers a compliant structured wiring system which will meet or exceed the performance standards for which it was purchased and to stand behind those products to ensure our customers the highest quality, best performing structured cabling systems available today.
THIS WARRANTY SHALL BE IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED,INCLUDING ANY WARRANTY OF MERCHANTABILITY OR WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE.
This warranty will cover any defects in design or installation of the cabling system that results from failure to comply with the Standards in affect when the system was installed.
NextSpeed Inc. shall in no event be liable to the End-User for collateral or consequential damages of any kind. NextSpeed Inc. shall provide any necessary labor for repair or replacement of product which results in a failure due to design or installation at NO CHARGE to the Customer.
NextSpeed Inc. shall not otherwise be liable for loss,damage or expense directly or indirectly arising from the use of the system or from any other cause. The sole and exclusive remedy against NextSpeed Inc.,whether a claim sound in contract, warranty tort or any other legal theory,shall be repair or replacement of the product including the labor to replace or repair the product only.
NextSpeed Inc. warrants its passive structured cabling system against defective materials or workmanship for a period of one (3) year from the date of purchase. The liability of NextSpeed Inc. under thias warranty is limited to replacing or repairing (at NextSpeed Inc. discretion) any products which result in a failure due to faulty design or installation, provided that:
The Purchaser, upon discovery of any defects, notifies NextSpeed Inc.
The defective product was installed by NextSpeed Inc. and the defective product is inspected by an employee or agent of NextSpeed Inc.
Upon inspection of the defective product, NextSpeed Inc. is satisfied that misuse,neglect, installation by others or unauthorized modification did not cause the defect..
